I am no expert, but I would say the only way she loses this lawsuit is if she doesn't have the means to adequately defend herself. On top of that, if she gets a good lawyer, she could probably counter-sue and get something for the estimated losses she took from all this nonsense.

Trademarks are meant to protect your IP not completely stop the use of the words or phrases that are under the trademark in regards to other things. There are plenty other examples of the term Space Marine in science fiction literature and other entertainment forms. You don't see GW going after them because they know that it would be fruitless. They bully the smaller people for no apparent reason... Seriously... what did GW have to gain from this lawsuit?

They have to sue, to prove that they are trying to protect GWs claim. That way when they actually have a breach in copyright, they breachers can't turn round and say you didn't protect it then.

GW claimed the Trademark on Space Marine in electronic media back in 1995, so there has been plenty of time for anyone to question this. But to be honest it's just business. Let the courts decide. How is this different to Marvel & DC owning "Super-Hero" or Facebook actually trying to Trademark 'Book'?

People need to look at the real picture. GW is just protecting their own IP.
They have to make these claims to be sure no one else does. It's not bullying, it's just how big business works, get over it.

It pains me that such a malicious organization makes such a brilliant game. I love their product, but I hate the company. Sometimes I feel like selling (or sometimes even just trashing) all my 40k stuff, but then I say stuff like, "I do it to have fun with friends, so it's OK" and call it a day. But is it really OK? Am I hurting other people by supporting GW? Sometimes I just wish that bad guys would be bad guys through and through so that the answer would be simple.

It's in the best interest of artists everywhere to learn as much as they can about trademark and copyright. This author SHOULD have a good case, but certain large companies rely on the cost of lawsuits to stop the use of terms. Meaning, unless the author got a $1,000,000 signing bonus, she's not going to have the funds to pay an attorney for her defense. Therefore, she doesn't pursue it and simply stops using the term. You want some real fun? Look up the suit against chapterhouse studios. A large firm actually represents them pro bono (presumably, they have a friend at the firm, or one of the attorneys plays wargames and is sick of GW's crap).

Poor writers probably never even heard of gw or any of their products, until she was served the letter containing every writers dread, as a writer myself I hope it never happens to me, so every time I figure something new in my stories I google it consistently, until I'm satisfied it is an original concept, or if it is entirely different from its original.
